Article 1: Subject
This contract covers the rights and obligations of the parties under the regulatory provisions of the Law No. 4077 on the Protection of Consumers regarding the sale and delivery of the product specified by the seller, the sale to the buyer, the quality of the sale, and the sale price; and the Regulations on the Basics and Procedures for the Implementation of Distance Contracts.
Article 2: Seller Information
Heyplays: Heyplays Ltd, representing the e-commerce site Heyplays.com.
Article 3: Buyer Information
All members: All buyers who are members of the company’s e-business store heyplays.com (referred to as “Buyer” or “Customer”).
Article 4: Content and Product Information
The type, quantity, brand/model, color, specification, sale price, and payment form of the goods/products or services are as specified on the site, and these may change without notice to the Buyer.
Article 5: General Rules
5.1 – The Buyer declares that they have read and informed themselves about all preliminary information concerning the basic characteristics of the product, the sale price, and the payment and delivery dates, and has given the necessary confirmation in electronic form.
5.2 – The contract product shall be delivered to the person or institution at the address indicated by the Buyer within the time specified in the preliminary information, provided that the legal period of 30 days is not exceeded.
5.3 – If the contract product is to be delivered to a person or organization other than the Buyer, the Seller shall not be held liable if the person or organization does not accept the delivery.
5.4 – The Seller is responsible for providing support during the warranty period specified for the product, ensuring it is complete and in accordance with the characteristics specified in the order, and accompanied by warranties and usage certificates, if any.
5.5 – The contract is subject to the condition that the product delivery is confirmed electronically and that the price is paid in the form of payment preferred by the Buyer. If the product price is not paid or is canceled in the bank accounts for any reason, the Seller shall be exempt from the duty to deliver the product.
5.6 – If, after the delivery of the product, the bank or financial institution fails to pay the product price to the Seller on the grounds that the credit card has been used unfairly or unlawfully by unauthorized entities, the Seller must be notified within 3 days. In such a case, the shipping costs shall be borne by the Buyer.
5.7 – If the Seller is unable to deliver the product within the time limit due to unforeseen circumstances such as cessation of service or adverse weather conditions, the Buyer will be notified. The Buyer may then cancel the order, request a replacement product, or postpone delivery until the situation is resolved. If the order is canceled, the Seller will process the refund within 14 days.
5.8 – If the product delivered is faulty or damaged, it must be sent back to the Seller for repair or replacement within 7 days of delivery, with shipping costs covered by the Seller. After 7 days, the Buyer must take the product to the relevant service center.
5.9 – This contract shall enter into force after it has been electronically approved by the Buyer (after payment).
Article 6: Right of Withdrawal
Due to the nature of digital game products, returns are not accepted. By completing the purchase, the Buyer agrees to waive the right of withdrawal.
Article 7: Competent Court
For disputes arising from this Agreement, the Consumer Arbitration Committees and the Consumer Courts at the place of residence of the Buyer or Seller shall have jurisdiction within the limits declared by the Ministry of Industry and Trade. By confirming the order electronically, the Buyer is deemed to have accepted all the provisions of this Agreement.
Article 8: Player Market
a) The accuracy of the information contained in the ads on the marketplace is not verified by Heyplays, and the Seller (Heyplays Ltd) is solely responsible for the correctness of such information. The Seller shall cover any losses arising from incorrect information.
b) Heyplays provides a payment and delivery guarantee between the Buyer and Seller. The price paid by the Buyer is secured until the goods or services are delivered.
b.1) After the purchase is completed, Heyplays shall not be liable for any adverse circumstances that may arise between the Buyer and the Seller.
b.2) In the event of any dispute, Heyplays has the right to block the payment in a secure account until a settlement is reached or a court decision is made.
b.3) The Buyer’s payment will be secured until the full delivery of the service or product, which may take up to 48 hours from the completion of delivery.
c) The Seller declares that they are authorized to list and offer for sale the goods or services on the Site.
d) The Seller is responsible for any undue withdrawals or injuries caused to the Buyer by the products sold and will be liable for compensation.
e) The Buyer and Seller will be liable for any losses if they complete transactions without using Heyplays’ services. Heyplays will not be responsible for such transactions.
f) Heyplays does not intermediate in any way for transactions for goods or services on the Market.
